On December 15, 2022, the California Occupational Safety and Health Standards Board (“OSHSB”) promulgated new and permanent General Industry Safety Orders (“Permanent Standards”) setting forth workplace health and safety requirements related to COVID-19 (8 C.C.R. §§ 3205-3205.3).

The Permanent Standards will replace the Emergency Temporary Standards (“ETS”), which OSHSB previously promulgated and which established certain requirements related to employers’ response to COVID-19 workplace health and safety issues.

The Permanent Standards will take effect following review and approval by the Office of Administrative Law (“OAL”) and posting by the Secretary of State and remain in effect for two years following the effective date, unless subsequently extended. (Government Code § 11349.3)

The attached Model COVID-19 Prevention Program (“CPP”) addresses and accounts for the regulatory requirements provided for in the Permanent Standards.

On February 10, 2022, Governor Newsom signed SB 114, which provides for COVID-19 Supplemental Paid Sick Leave (SPSL), into law.  The new law requires employers that employ 26 or more workers to provide SPSL to employees retroactive to January 1, 2022 and through September 30, 2022.  Liebert Cassidy Whitmore has prepared a template SPSL Policy and forms in order to assist clients in complying with these new legal obligations.  SB 114 becomes effective, February 19, 2022. In 2023, in order to address growing concerns about violence in the workplace, the legislature passed and the Governor signed into law Senate Bill 553. The new law amends Labor Code section 6401.7 and adds Labor Code section 6401.9, requiring California employers to establish and implement by July 1, 2024 a Workplace Violence Prevention Plan (“WVPP”) and provide effective training to employees on the requirements of the new law and the employer’s WVPP.
